A Sumner man was arrested July 24 after allegedly violating restrictions related to Iowa’s sex offender registry.
According to the Bremer County Sheriff’s Office, deputies were dispatched to the Sumner Public Library after receiving a report that Phillip M. Hamby, 48, was on library grounds.
Authorities said Hamby told deputies he did not have written permission to be at the location. Deputies also confirmed there were no exceptions in his file allowing him to be on the library property or the adjacent Water Tower Park, which is located between the library and a child care facility. Investigators said both facilities are within 300 feet of the park.
According to the criminal complaint, Hamby was at the park with his fiancée and son while his son played with other children. Authorities allege Hamby did not know the other children who were present.
Hamby was arrested and transported to the Bremer County Jail.
Court records show Hamby plead guilty in 2017 following a lengthy legal proceeding to two counts of lascivious acts with a child, both Class C felonies, under a negotiated plea agreement. The convictions stemmed from charges originally filed as second-degree sexual abuse in 2014. He was sentenced to two consecutive 10-year prison terms, later received suspended prison sentences and was placed on five years of probation with conditions that included sex offender treatment. He is also required to register as a sex offender under Iowa law.
The new charge remains pending in Bremer County District Court.
